Should I sign a prenuptial agreement?
A couple may consider signing a premarital or marital agreement for a number of reasons. For example, a premarital or marital agreement may be sought to protect a family business or family wealth, it may be used to protect an inheritance for children from a prior relationship, or it may be used to help avoid or minimize litigation in the event of a divorce.
The most common areas that are addressed in premarital and marital agreements include:
Maintenance (alimony)
Property rights
Responsibilities for Debts
Payment of attorney’s fees
Rights of a spouse upon death
The process for entering into a premarital or marital agreement is important and must be followed in order to help ensure the agreement is later enforceable. [1] Thus, parties contemplating a premarital or marital agreement should consult with competent legal counsel.
